Policies, Terms & Coniditons

This Rental Agreement outlines the terms and conditions between Luxe Events Corpus Christi, LLC (“Lessor”) and the Client (“Customer”) for the rental of soft play, bounce house, and related event equipment. By signing, the Client agrees to comply with all safety, setup, weather, and payment policies, and acknowledges full responsibility for the care, supervision, and proper use of the rented equipment. This agreement is legally binding and designed to protect both parties while ensuring a safe, professional, and enjoyable event experience.

Should Customer request more than 2 additional colors beyond the base, a $10 accessory fee will be applied per additional color.
 
Fees That May Apply

To ensure the safety and longevity of our equipment, Luxe Events Corpus Christi, LLC will not set up if there is even a 1% chance of rain. If, during setup or while en route to the event, we experience any rainfall or precipitation, setup will be immediately discontinued, and all equipment will be removed. Our equipment cannot be exposed to any form of moisture, as it may cause significant and costly damage. In the event that setup cannot proceed due to weather conditions, only 50% of the baseline soft play rental fee will be refunded (equal to $162.50). No travel fees or add-ons will be included in this refund. This partial refund accounts for the time, labor, preparation, and transportation already incurred prior to cancellation.

It is the client’s responsibility to have a contingency or backup plan (such as a fully covered or indoor area) in the event of inclement weather. Our team monitors forecasts the day prior and the morning of the event; however, final responsibility for ensuring suitable conditions lies with the client.

Additionally, to ensure proper installation and prevent equipment damage, a solid, flat surface is required for all setups. We do not set up on gravel, dirt, thick grass, uneven surfaces, or any unstable areas. If a suitable setup area is not available upon arrival, we reserve the right to refuse setup, and no refund will be issued.

If weather conditions change during the event (including rain, strong winds, or heavy moisture), the client must contact Luxe Events Corpus Christi, LLC immediately so we can safely and promptly secure or remove our equipment. Failure to communicate such weather changes may result in damage that is clearly identifiable upon inspection, even if photos are taken later once weather permits. In such cases, the client’s payment method on file and/or an invoice will be automatically charged a weather negligence fee ranging from $100–$200, depending on the extent of damage or cleanup required. This fee covers the additional time, effort, and restoration necessary to clean, dry, and repair equipment that has been exposed to weather without proper notice.

Our priority is always the safety of our equipment and staff, and we greatly appreciate clients who maintain transparency and timely communication to help prevent weather-related damage.

Safety and Operating Instructions

In addition to the information set forth in this agreement, Customer acknowledges that safety and operating instructions are provided on or with the Equipment delivered. Customer agrees to read, understand, and comply with all instructions prior to operation, and to ensure that anyone operating or using the Equipment does so safely and in accordance with these guidelines.

Customer further acknowledges and understands that Lessor has not provided, nor agreed to provide, any on-site operators or attendants for the rented Equipment. Customer is solely responsible for the correct and safe operation, supervision, and use of all Equipment during the rental period.

Customer agrees to keep all Equipment away from swimming pools, sprinklers, hoses, or any other water sources, and understands that no electrical Equipment shall be operated near water.

By entering into this Agreement, Customer acknowledges that there are inherent risks of injury or damage arising from the use of inflatable or play equipment. Customer voluntarily assumes all such risks and agrees to maintain all required safety rules, proper supervision, and correct installation and operation of the Equipment.

Customer agrees to take all necessary precautions regarding the rented Equipment and to protect all persons and property from injury or damage. Customer acknowledges that they are solely responsible for the operation, installation, supervision, and use of the Equipment, as well as its return in good working order.

Customer acknowledges and agrees that Luxe Events Corpus Christi, LLC (“Lessor”) is not responsible for any injury, loss, or damage occurring to the Customer, the Customer’s guests, or any other individuals using the Equipment, nor for any claims by third parties arising from the use or possession of the Equipment while in the Customer’s control.

Customer agrees to defend, indemnify, and hold harmless Lessor and its owners, agents, employees, contractors, and installers from and against any and all liabilities, claims, judgments, attorney’s fees, or costs of any kind — including, but not limited to, personal injury, death, or property damage — arising out of or related to the use, maintenance, installation, operation, possession, or rental of the Equipment.

This indemnity applies whether such claims arise from the negligence (active or passive) of Lessor or its representatives, or from any other cause, provided the incident occurred while the Equipment was in the Customer’s actual or constructive possession.

Cost

The first payment is a non-refundable deposit of $75.00, which will be applied toward the total rental balance. The deposit compensates Luxe Events Corpus Christi, LLC for reserving your date and declining other potential bookings. A $150 refundable cleaning fee will be charged upon final payment. This fee will be reviewed and determined by the Lessor based on the condition and cleanliness of the Equipment upon pickup. Refunds (if applicable) will be issued within (48) business days after the Lessor has completed their inspection and determined that the Equipment was properly cared for and returned in satisfactory condition.

If rain, wind, or unsafe conditions prevent setup, the Client must provide an alternative indoor or covered location. Once Luxe Events has completed setup and the rental period has begun, no refund will be issued.

Deliveries past 20 miles from Lessor’s location will be charged $2.00 per mile round trip.

Possession and Title

Customer’s right to possession of the Equipment begins upon delivery to the Customer’s premises and ends upon actual pickup by the Lessor. Retention of the Equipment, or failure to permit its pickup at or after the end of the “Rental Period,” constitutes a material breach of this Agreement.

If the Equipment is not returned for any reason, including theft, the Customer must pay the Lessor the full replacement value of the Equipment as listed on the front of this Agreement, plus any incidental costs associated with pickup or recovery efforts.

Title to the Equipment remains with the Lessor at all times. Customer agrees to keep the Equipment in their custody and control from delivery until pickup and shall not sublet, rent, sell, move, or otherwise transfer the Equipment from the Delivery Address.

If the Equipment is not returned or is levied upon for any reason, Lessor may retake possession without further notice or legal process, using reasonable force if necessary. Customer agrees to indemnify, defend, and hold Lessor harmless from any claims or costs arising from such recovery.

If the Equipment is levied upon or moved from the Delivery Address, Customer must notify Lessor immediately.

Charges: Customer may be charged up to $4,000.00 for loss or damage to the Equipment, plus legal fees.

Care of the Equipment

Customer is responsible for all damage to Equipment not caused by ordinary wear and tear, which refers only to normal deterioration from proper and reasonable use.

Equipment will not be set up outdoors in the event of rain or the threat of rain. Customer must provide a safe indoor location.

Customer is liable for all damage beyond ordinary wear and tear, including but not limited to:

Cuts or tears to vinyl, leather, or netting

Overturning, overloading, or improper use

Lack of cleaning or drying

Water damage from rain, sprinklers, hoses, or water toys

Contamination with food, chemicals, paint, silly string, mud, or similar materials

If a tornado threat exists on the rental date, the Lessor will not deliver the Equipment and will refund the Customer’s deposit within ten (10) business days.

Equipment Problems

If any Equipment malfunctions, fails to operate, or Customer does not understand the operating instructions, Customer must immediately stop using the Equipment.

For Bounce Houses or similar inflatables:

If the unit deflates, have all participants exit immediately.

Check whether the motor has stopped and confirm that the power cord is properly connected.

If the motor is running, inspect the air intake screen and both air tubes for blockages or loose connections. Reattach and tighten as necessary.

Once the issue is resolved, fully re-inflate before allowing use.

If the problem persists, contact us immediately.

Rules and Instructions for Use
a. All posted safety and operating instructions must be followed at all times.
b. Adult supervision is required at all times. No one under the influence of alcohol, drugs, or medication may operate or supervise Equipment.
c. No participant with an existing injury may use the Equipment.
d. Silly String, slime, facepaint or similar substances are strictly prohibited. Contact with these materials causes irreparable damage and will result in a $2,000.00 fee.
e. Participants must remove sharp/bulky items before use.
f. No horseplay in or around the Equipment. No one may sit or stand on walls or slides.
g. Extra caution is required for children ages three (3) and under.
h. No food, drinks, face paint, markers, shoes, slime, glitter, confetti, streamers, or silly string inside the ball pit/ softplay/ bounce house area. Violation will result in a $4,000.00 fee.
i. No water in or around the Equipment. Water damage will result in a $4,000.00 fee.
j. Customer may NOT move the Equipment.
k. All balls must be returned to the ball pit before pickup. Missing balls will incur a $50.00 fee.
 
Limited Warranty

Lessor warrants that all Equipment will be in good working order upon delivery. This limited warranty covers repair or replacement only, as determined by Lessor.

Lessor makes no warranty of merchantability or fitness for a particular purpose, express or implied, and shall not be liable for any loss, injury, or damage arising from the use, operation, or failure of the Equipment. Lessor is not responsible for defects or failures unknown at the time of delivery.

Compliance with Laws

Customer agrees not to use or allow anyone to use the Equipment illegally or unsafely. Customer is solely responsible for complying with all local, state, and federal regulations, including obtaining necessary permits or licenses. Customer must pay all related fees, taxes, and fines arising from their use of the Equipment.
If an attorney is retained to enforce any provision of this Agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees and court costs as determined by the court or arbitrator.

If any part of this Agreement is found unenforceable, illegal, or unconscionable, that portion shall be removed, and the remainder shall remain in full force and effect.

Cancellation Policy

Cancellations made 30 days or more prior to the event will receive a refund of the rental amount minus the non-refundable $75.00 deposit.The $75.00 deposit may be applied as a rain check toward any rental within twelve (12) months of the cancellation date.

Cancellations made less than 30 days before the event will be refunded only for materials not yet purchased. The $75.00 deposit remains non-refundable.

Cancellations within 72 hours or on the same day will result in a charge for the entire rental amount, including the non-refundable deposit.

All cancellations must be made via email, phone, or direct message and confirmed by Luxe Events Corpus Christi, LLC. No refunds will be issued for any reason, including weather.

Terms and Conditions/Customer Acknowledgment

This agreement outlines the responsibilities and liabilities between Luxe Events Corpus Christi, LLC (“Lessor”) and the Customer (“Client”). By signing/ initialing this document, Client agrees to comply with all safety, weather, surface, and operational requirements.
Customer acknowledges that they have read and fully understand this Agreement, agree to be bound by all terms, and are signing freely and voluntarily without duress. This Agreement represents the full and complete understanding between the Lessor and Customer. Any prior agreements, verbal or written, are superseded.

By signing/ initialing below, Customer acknowledges receipt of the Equipment in good working condition and agrees to all terms and conditions herein. The undersigned affirms that they are authorized to accept delivery and sign on behalf of the Customer, and personally agree to be bound by this Agreement.

I understand that the terms of this authorization will remain in effect until I request that they be terminated. I acknowledge that I am responsible for making this request in writing.
